1. Acceptance
By using the Deyar Digital website or the DeyarIS platform, you acknowledge that you accept and agree to be bound by these terms. If you use them on behalf of an organisation, you represent that you are authorised to bind that organisation to these terms. If you do not agree, please do not use the website or platform. Use of the DeyarIS platform may also be subject to a separate subscription agreement with your organisation, which prevails over these terms in the event of a conflict regarding the platform.
2. Permitted use and accounts
You may use the website and platform only for lawful purposes and in accordance with these terms. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account, and you agree to notify us promptly of any unauthorised use. You agree not to misuse the service, including by attempting to gain unauthorised access to it, disrupting it, reverse-engineering it, or using it in a way that breaches applicable laws in the Kingdom or infringes the rights of others.
3. Intellectual property and marks
The DeyarIS platform, the Deyar Digital website, and all software, content, designs, logos and trademarks they contain remain the property of Deyar Digital or its licensors, protected under intellectual property laws. These terms grant no ownership rights; instead they grant a limited, non-exclusive, non-transferable licence to use the service in accordance with these terms. The Deyar Digital and DeyarIS names and logos may not be used without our prior written permission. Data that a customer uploads into the platform remains owned by the customer.
4. Availability and changes
We aim to make the website and platform available reliably, but we do not guarantee that they will be uninterrupted or error-free, and we may carry out scheduled or emergency maintenance, or modify or discontinue features. We may also update these terms from time to time; an update takes effect once published on this page with a revised "Last updated" date, and your continued use of the service thereafter constitutes acceptance of the updated terms.
5. Disclaimers and limitation of liability
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, beyond what applicable law requires. The service is not a substitute for specialist legal or professional advice, and responsibility for decisions based on its output rests with the user. To the extent permitted by law, Deyar Digital is not liable for any indirect, consequential or incidental damages, loss of profit, or loss of data, and its total liability arising from the service will not exceed the amounts you paid us for it during the twelve months preceding the event giving rise to the claim, without prejudice to any rights that cannot lawfully be excluded.
6. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. The competent judicial authorities in the Kingdom have jurisdiction over any dispute arising out of or in connection with them.
